Germany expands labour markets, for skilled workers in non-EU countries

The new German Skilled Immigration Act came into effect for the relocation of skilled workers to Germany in early 2020. The new legislation offers skilled workers outside the European Union with greater opportunities to work in Germany. The new German Skilled Immigration Act now makes non-EU nationals, who wish to work in Germany subject to simpler procedures and laws.

The new legislation is meant to make it possible for qualified immigrants from non-EU countries to access the German labour market and grab the employment opportunity in Germany, by allowing migrants for up to one-half year to come to Germany to seek employment. This law allows them to work for those positions as well that may be held by Germans and EU citizens.
This would also increase the number of jobs in Germany. Many roles remain vacant, as a result of the shortage of skills and workers,
These are the main changes to the regulations for operating in Germany as a professional non-EU citizen which have been mentioned and clarified.
Qualified professionals eligible under the current legislation
The new legislation has expanded the number of professionals who are currently deemed to be qualified for jobs in Germany.
In addition to those with a tertiary education degree, the current legislation also acknowledges non-EU citizens with technical degrees, vocational training qualification, obtained and qualified for at least two years of training such professionals are also eligible to access jobs in Germany.
Therefore, in order to work legally in Germany, the worker must fulfill the following basic conditions:

• He/she must have a formal foreign qualification/ certification officially recognized by the appropriate authority in Germany.
• In their area of expertise/ field of professionalism, he / she should have a job contract / offer by an employer in Germany.

As per the previous condition, a job that could be fulfilled by a German or EU national staff was not formally permitted to be undertaken by non-EU workers, this is not the case anymore. There are no further priority reviews by the Federal Employment Agency in this regard.
In fact, the new guidelines widen international workers' areas of employment and allow them and work in an industry that is not traditionally their area of study.
They can also work in occupations that are not mandatory for tertiary training (qualified practitioners with advanced degrees only), or in careers other than subordinate and semi-qualified careers that typically require technical non-academic qualifications. Their job is no longer subject to occupation for which there is lack of skilled EU residents.

Visas for the period of Six-Month to Search Work in Germany
For non-EU citizens with a credential approved by the appropriate body in Germany it is now possible to migrate to Germany for up to six months to find a job.
For Germany Jobseeker visa, foreign workers who have enough funding to support themselves during their stay and German knowledge at least B1 levels of the Common European Framework of Reference for Languages can apply for Jobseeker visa in Germany.
The visa permits the applicant to work up to 10 hours within a week which enables him to show his potential and also his potential employer to know if they are suitable for each other or not.
Visa for Training and Skill Development in Germany
Individuals who requested the approval process from the appropriate body in Germany abroad and have received a negative response that their certification has now not fully met with the criteria of German qualifications.
They can also come to Germany with a training and skill development visa, providing the condition that you do have the necessary German skills A2 level according to the Common European Framework of Reference for Languages,.
A visa such as this corresponds to a residency permit which is valid for 18 months which can be renewed /extended for another four months, and possibility to apply for a residence permit is available before its validity expires.
As a trainee – Coming to Germany
Under the new regulations, non-European students under the age of 25 with a B2 level of German language skills and the capacity to support themselves financially will find a place for training in Germany.
They may however submit a certificate of school leaving from a German school abroad or a certificate of school leaving which grants a citizen the right to higher education.
A migrant can also attend a German language school, either in general or profession-related, with a residency permit for a vocational training course.
Now students can easily change the status of their residence
Students in Germany who wish to change their status of residency have the option to do so better than ever.
These students can continue their vocational training and obtain a residency permit to attend a vocational training course instead of pursuing their studies.
And, while studding or pursuing technical training (under such conditions) they may be offered a position as a skilled professional.
Compared to immigrants, who have successfully completed vocational training program in Germany, they can apply to for a permanent settlement permit upon completion of a two-year period in country and the same term is for graduation students in Germany.
What Changes Occur for Companies Hiring non-EU Workers?
Companies who employ staff outside the EU will now follow facilitated processes and regulations after the latest regulation comes into force. The facilitation developed included streamlined trials by the appropriate international registry office in Germany for skilled professionals.
Firstly, an understanding is developed among the recruiting firm and the international registration office. The arrangement shall contain hearings, parties, timelines and attorney's powers. The responsibilities for the client, the trained practitioner and the authorities will also be defined.
Secondly, under such time limits the international registry office seeks clearance from the Federal Employment Department.
After all requirements are met, the Office shall give permission in an advance to the employer. The employer must then pass approval to the qualified professional worker.
The qualified person then follows the protocols and procedures for securing the employment visa from his country of origin for Germany.
Visa for E-Sports
In compliance with current regulations, athletes and sports trainers may now apply for a visa to allow them to move to Germany and obtain work residency permits.
In this case permission is not required from the German Federal Jobs Department. Applicant would have to fulfill certain criteria; Applicant must be above 16 years of age and with a minimum 50% of the salary threshold requirement of statutory pension insurance,
Moreover, athletes' sporting credentials or technical competences are recognized with common consensus by the German Athletics Association and the Sports Central Association.
